Only you, or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

You may make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.  Making a verifiable consumer request does not require you to create an account with us.  We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

Response Timing and Format

Subject to the Privacy Policy, anything that you submit or post to the Sites or to PEARL iZUMi, including ideas, know-how, techniques, questions, comments, and suggestions (collectively, “Submissions”) is and will be treated as nonconfidential and nonproprietary. By submitting or posting a Submission to the Sites or to PEARL iZUMi, You waive any and all rights you may have in such Submission (except as to matters covered by the Privacy Policy). PEARL iZUMi shall have the exclusive, royaltyfree, worldwide, perpetual, and transferable right to use, copy, reproduce, distribute, display, perform, sell, lease, transmit, or create derivative works from any such Submission by any means and in any form, and to translate, modify, reverse-engineer, disassemble, or decompile any such Submission. All Submissions shall automatically become the sole and exclusive property of PEARL iZUMi, without compensation to you, and shall not be returned to you.

PEARL iZUMi’s obligations with respect to its products are governed solely by the agreements under which they are provided and nothing on the Sites should be construed to alter such agreements. In addition, PEARL iZUMi does not warrant the accuracy or completeness of the materials on the Sites. If, notwithstanding the other provisions of these Terms, PEARL iZUMi is found to be liable to you for any damage or loss which arises out of or is in any way connected with your use of the Sites or any materials contained thereon, PEARL iZUMi’s liability shall in no event exceed U.S. $100.00.

Terms of Sale

Goods offered for sale on the Sites are solely for end-users. Your purchase is for your own use, not for resale, export, re-export or transfer. Any order is an offer to buy. PEARL iZUMi may send an order confirmation email to acknowledge receipt of your order, but PEARL iZUMi does not accept your order until we send you notice that the goods have been shipped. PEARL iZUMi may process payment for and ship parts of an order separately. PEARL iZUMi reserves the right at any time, even after we send you a confirmation email, to decline or cancel your order or to limit order quantities for any reason, including errors or suspected fraud, or orders that may be intended for resale.
